This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and what rights you have, in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

This policy applies to personal information collected through mmasi.co.za, our RFQ and “Book an Energy Assessment” forms, our online store, email, phone, and any in-person engagements related to a quotation or project.

2. What Personal Information We Collect

Depending on how you interact with us, we may collect:

  • Contact details — name, email address, phone number, company name, job title.
  • Enquiry and RFQ details — site type, current power setup, headcount or sizing information for bulk PPE/workwear orders, delivery address, and project requirements you submit through our forms.
  • Order and billing information — delivery address, billing address, order history, and payment confirmation details (note: MMASI does not store full payment card details — these are processed securely by our payment gateway provider).
  • Account information — if you register a “My Account” profile on our online store, we collect your login details and order history.
  • Site visit and consulting data — where you engage us for an energy assessment or consulting service, we may collect operational or energy-usage data you share with us for the purpose of that engagement.
  • Technical information — IP address, browser type, device information, and browsing behaviour on our website, collected automatically via cookies and analytics tools (see Section 5).
  • Communications — records of emails, calls, and messages exchanged with our team.

We do not knowingly collect special personal information (as defined under POPIA, e.g. health, religious belief, or biometric data) through this website, and we do not collect information from children without the consent of a parent or guardian.

3. How We Collect Your Information

We collect personal information:

  • Directly from you, when you submit an RFQ, contact form, “Book an Energy Assessment” request, place an order, or email/call us.
  • Automatically, through cookies and analytics tools when you browse our website.
  • From publicly available sources, such as your company website or LinkedIn, where relevant to a business enquiry.
  • From third parties involved in fulfilling your order or engagement, such as couriers, where necessary to complete delivery.

4. Why We Process Your Information (Purpose)

We process your personal information for the following purposes:

  • To respond to enquiries and prepare quotations for PPE, workwear, footwear, and BESS/consulting engagements.
  • To process, fulfil, and deliver orders placed through our online store or against a confirmed quotation.
  • To manage ongoing bulk-supply or consulting client relationships, including account and site history.
  • To communicate with you about your order, quotation, or project status.
  • To improve our website, products, and services, including through website analytics.
  • To meet our legal, tax, and accounting obligations under South African law.
  • Where you’ve opted in, to send you relevant updates about our services (see Section 8, Direct Marketing).

Our website uses cookies and similar technologies to:

  • Enable core site functionality, including the shopping cart and account login.
  • Understand how visitors use our site, using analytics tools, so we can improve content and user experience.
  • Support any live chat or chatbot functionality used for customer enquiries.

You can control or disable cookies through your browser settings at any time. Disabling certain cookies may affect the functionality of the online store (e.g. the shopping cart).

6. Our Legal Basis for Processing

Under POPIA, we only process your personal information where we have a lawful justification to do so, which includes:

  • Contractual necessity — where processing is required to prepare a quotation, fulfil an order, or deliver a service you’ve requested.
  • Legal obligation — where we’re required to retain information for tax, accounting, or regulatory purposes.
  • Legitimate interest — where processing (e.g. basic website analytics) is reasonably necessary for our business operations and does not unreasonably infringe on your privacy.

7. Who We Share Your Information With

We do not sell your personal information. We may share it with:

  • Delivery and logistics partners, to fulfil orders and deliveries.
  • Payment processing providers, to securely process online payments (MMASI does not store your full card details).
  • Sub-contracted installers or accredited technical partners, where necessary to deliver a BESS installation or site-based engagement, and only to the extent required for that engagement.
  • IT service providers, including our website hosting and email service providers, who process data on our behalf under confidentiality obligations.
  • Professional advisors (e.g. our accountant), where necessary for legal or financial compliance.
  • Regulators or law enforcement, where required by law.

Where any of our service providers process personal information on servers located outside South Africa (for example, cloud-based hosting or email tools), we take reasonable steps to ensure that information is subject to a level of protection consistent with POPIA.

8. Direct Marketing

In line with POPIA’s requirements on direct marketing, we will only send you marketing communications (such as service updates or newsletters) where:

  • You are an existing client and the communication relates to similar products or services, or
  • You have given consent to receive marketing communications.

You can opt out of marketing communications at any time by clicking “unsubscribe” in any email, or by emailing info@mmasi.co.za. Opting out of marketing does not affect transactional communications related to an active order or quotation.

9. How Long We Keep Your Information

We retain personal information only for as long as necessary to fulfil the purpose it was collected for, including:

  • Order and transaction records — retained for the period required under South African tax and accounting legislation.
  • Quotation and enquiry data — retained for a reasonable period to support follow-up and ongoing client relationships, or deleted if no engagement results.
  • Marketing consent records — retained until you opt out or request deletion.

Where information is no longer needed, we securely delete or anonymise it.

10. How We Protect Your Information

We take reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, alteration, or disclosure, including secure website hosting, restricted internal access to client data, and the use of reputable, secure third-party payment processing. No online transmission or storage system can be guaranteed 100% secure, and we encourage you to contact us immediately if you suspect any unauthorised use of your information.

11. Your Rights Under POPIA

As a data subject, you have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate, outdated, or incomplete information.
  • Request deletion of your personal information, subject to our legal retention obligations.
  • Object to the processing of your information for direct marketing purposes at any time.
  • Withdraw consent, where processing is based on consent, at any time (without affecting the lawfulness of processing before withdrawal).
  • Lodge a complaint with us directly, or with the Information Regulator (South Africa), if you believe your information has been processed unlawfully.
